1. Terms & Conditions: These terms and conditions under this agreement (“User Terms”) apply on the usage of our website www.giftnplants.com (‘Website’), Service and to all information, recommendations and/or services provided to you through the Website and/or through our Customer Care (“CC”). The terms and conditions mentioned in this contract along with the Privacy Policy constitute the entire contract between the User (as defined below) and GIFTnPLANTS with respect to access and use of the website and the Services offered by GIFTnPLANTS, superseding any prior written or oral contracts in relation to the same subject matter herein. The term “You / Your” refers to the User of Service, Website and the CC.
2. Definitions: ‘Products’ shall mean goods offered by GIFTnPLANTS on Merchant’s shop or e-commerce website. ‘User’ shall mean any individual or entity as approved by GIFTnPLANTS.
3. User Accounts: It is assumed that all information provided by the User for signing up on the Website is correct and accurate (especially PINCODE) and up to date. After placing the order, customer receives an E mail showing address and ordered items. Customers are requested to cross check their address for to ensure correctness. However, in case of any change in address, we request customers to inform us at the earliest (Within 12 hours of placing order). We will take up with courier partner for the needful action.
4. Shipping time: If customer order is having only Garden items (without plants), the order will be despatched from our Godown within 2 working days (excluding excessive rain, natural calamity or Holidays). But if your order is having plants also, we may need upto 5 working days to ensure safe and professional packing of plants. Plants’ consignment will be despatched on a day, so that upcoming holidays may not delay the journey of the consignment.
5. Refund / Cancellation / Replacement/ Return: Due to any unavoidable reasons, if we could not despatch your consignment within this stipulated period, customers have the right for cancellation and refund of the order. Customers can cancel the order by informing us before despatch of the order. The received orders cannot be cancelled after despatch of order. We sell online and offline both ways. Due to off line sales, few products / plants may become ‘Out of stock’. Sometimes few products / plants are available with us, but not in good condition, we donot send such defective products to customer and the amount will be refunded in same account of the customer (within 2 weeks) which was used for making payment with our website. All our products / plants will show product details and specification along with image. Customers are to buy products after reading product description. Any claim regarding Refund / Cancellation / Replacement/ Return of any item will be entertained, only in case of discrepancy with product description.
6. If the order is not deliverable due to wrong / incomplete address (as per remarks of courier / post office) and the consignment is returned to GIFTnPLANTS, the user will be refunded order value after deducting shipping fee of both ways.
7. Plants size and image: Plants size and image are for reference only. We may display plant image with flowers only for better understanding and recognition of plants by the customer. Plants may show 10-20% difference in plants size, as shown on our website. Variegation of plants leaves and flower colour is continuous process and it’s variable as per availability of sunlight, humidity, water and soil type.
8. Safe delivery of plants / garden items: Since 2016, we are safely despatching plants with 90 % safe delivery of plants. But due to courier mishandling or any other unforeseen reasons, if customers receive dead plants, you have to send photos, videos of such plants within 24 hours of delivery. Unboxing videos will be more satisfying for clarification. In genuine cases, we have refunded suitably. Refund / replacement for such plants will be done on case to case basis with sole discretionary power of GIFTnPLANTS. No complaints regarding poor health of plants will be entertained after 24 hours of delivery.
9. Tracking details: The customer will be provided with tracking details of the consignments.
10. Due to operational constraints / unserviceable PINCODES, GIFTnPLANTS may refuse the Service to user.
11. Trademark : All related icons and logos are registered trademarks or service marks of GIFTnPLANTS / DORO KE FYTA in various jurisdictions and areprotected under applicable copyright, trademark and other proprietary rights Applicable Laws. The unauthorized copying, modification, use or publication of these marks is strictly prohibited. You cannot copy or distribute the GIFTnPLANTS content from our website without written permission from GIFTnPLANTS.
12. Governing Law and Dispute Resolution: The parties agree that the courts of Gandhinagar shall have exclusive jurisdiction over any dispute arising from or relating to the User Terms and/or the Website.
13. Consent to Accept Terms of This Agreement: By clicking on the tab/ button/ checkbox of placing an order with GIFTnPLANTS, you consent to Privacy Policy as displayed on the Website You agree and give your consent to receive communications from the Company via Whatsapp/ SMS/ E- mails regarding
i. Information relating to transactions recorded on the Website;
ii. Information about the Services;
14. Electronic communications shall be deemed to have been received by you when we send the electronic communication to the email address / mobile number / details provided by you during the sign-up process as per our records, or when we post the electronic communication on the Website.
15. We reserve the right to modify prices of our products without any prior notice.
16. This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000 This electronic record is generated by a computer system and does not require any physical or digital signatures.
